Silverleaf Resorts complaint by Lineaweaver
On March 2 we purchased a biannual timeshare from Oak 'N Spuce, a subsidiary of Silverleaf resorts, a Texas based corporation that markets timeshares for its resorts. During the sales presentation we made very clear that we were highly unlikely to vacation at any of their resorts, prefering to use our vacation time to visit friends and family, usually outside the US. Our purchase was based on the representation that for a specified fee our time could be exchanged for hotel rooms at the places of our choice, inside or outside the US, through RCI, an affiliated company that was represented as a "travel agency".

The day after our purchase we attempted to book rooms in Ocala, FL for one month later through RCI, but found we needed our RCI membership number to do so. We had to call Oak 'N Spruce to get that expedited to usThree days later. Upon again attempting to book rooms the following weekend, we found that RCI would only do a trade within their resort network.

Eight days after our purchase we tried to rescind our membership and were informed that we had only three days from the date of purchase within which we could rescind. When we pointed out that we didn't have the information upon which to base that decision until after the three days had expired, we were told by a Mike McInerney, in effect, too bad.

Calls to the corporate headquarters in Texas were routed back to Mr. McInerney. It seems that the sales representatives, who get commissions on their sales, are the sole authority on rights of rescision.

A strong word of warning - do not sign a timeshare agreement without adequate review by a lawyer of your choice. These people will say what it takes to make the sale, then you are handed an 11 page document to initial & sign throughout which is, it seems, a legally binding document. It would take a couple of hours to read & digest what is in that document.

I have to agree with you that Silverleaf is a scam and a completely dishonest organization to conduct business with. We purchased one of the sampler vacations. No where within the 3 page contract does it state you can't receive your deposit back. We requested our deposit and the rep that I spoke with today said that I would have to call back tomorrow it was after 5 pm central time and everyone was gone for the day. It was 5:03. I told her that I wasn't an idiot and there was no way that she could convince me that she was the only person in the building and that absolutely everyone had left. She put me on hold (I was completely expecting to be on the eternal holdline) and a few minutes later a supervisor came on the phone. She told me the only thing she could do was to honor the week vacation. She will have someone from legal call me tomorrow. I'm still fighting to get our deposit back. I guess if they tell me it's a no go. I will accept the one week vacation. I will go to the resort and I will wait for would be suckers to come in the door and I will talk to them and warn them about Silverleaf Resorts and to run away while they can. I will also direct them to this website. I will contact the local tv channels and ask them to warn the community. Maybe they won't give me back my money but I will certainly make them spend much more for advertising. Advertising is very expensive as it is and many organizations are cutting back on their advertising. I certainly will make them regret not giving me my money back. Maybe things will go well tomorrow with the legal department and I will get our deposit back. I guess if I not I have a plan in place. I will make sure that I know who all the salespersons are too, so that when they are walking around with potential customers I will interrupt and tell them the truth about Silverleaf Resort Scams.
